These Terms and Conditions ("Terms") govern your use of the islandmarinerepair.com website and the mobile marine repair and maintenance services provided by Island Marine Repair LLC ("Island Marine Repair," "we," "us" or "our"), a Florida limited liability company based in Fort Myers Beach, Florida. By using our website, requesting a quote or engaging our services, you agree to these Terms. If you do not agree, please do not use the website or our services.
1. Our Services
Island Marine Repair provides mobile boat repair, maintenance and related marine services performed at the customer's location: dock, lift, marina slip, driveway or storage facility, across Southwest Florida. Content on our website describes our services generally and is provided for information; it is not a guarantee of a specific outcome for a specific vessel, since every boat's condition, history and needs differ. Specific work for your vessel is defined by the written quote you approve.
2. Quotes, Estimates and Approval
Diagnosis comes first, and every repair is quoted in writing before work begins. A quote describes the work to be performed and its price, and no quoted work starts until you approve it. If additional problems are discovered once work is underway, we will stop, explain what we found, and obtain your approval before performing any additional work. Quotes are based on the vessel's condition as observed at diagnosis and remain valid for a reasonable period stated on the quote; parts availability and pricing from suppliers can change, and we will tell you promptly if they do.
3. Scheduling, Access and Cancellations
Service visits are scheduled by agreement. You agree to provide safe access to the vessel at the scheduled time, including gate codes, dock or lift access, marina authorizations and keys where needed. If we arrive as scheduled and cannot access the vessel, a return visit will need to be scheduled. Please give us reasonable notice if you need to cancel or reschedule, and we will always do the same for you; weather, tides and emergency breakdowns occasionally require schedule adjustments in this trade, and we communicate them as early as possible.
4. Authorization to Board and Work on Your Vessel
By engaging our services, you confirm that you own the vessel or are authorized by the owner to approve work on it, and you authorize our technician, and any trusted professionals working under our direction on larger jobs, to board the vessel, operate its systems as needed for diagnosis and testing, and perform the approved work. Where the vessel is located at a marina or community with its own rules, you are responsible for any authorization the facility requires for outside contractors, and we will cooperate with facility requirements, including providing proof of insurance on request.
5. Sea Trials and Test Operation
Some diagnosis and verification requires running the engine or operating the vessel, including brief sea trials. You authorize test operation reasonably necessary to diagnose problems and verify repairs. Where you prefer to be present or to operate the vessel yourself during a sea trial, tell us and we will arrange it that way.
6. Parts
We use genuine manufacturer parts and OEM-equivalent parts appropriate to the job, and your written quote states which. Special-order parts may require payment or deposit before ordering, as stated on the quote. Removed parts are available for your inspection on request at the time of service; unless you ask to keep them, removed parts are disposed of properly. Parts carry the warranty provided by their manufacturer.
7. Payment
Payment is due upon completion of the approved work unless other arrangements are agreed in writing. We accept the payment methods stated on your invoice. Amounts unpaid after the due date may be subject to reasonable collection steps permitted by Florida law. We keep pricing honest and transparent on the front end, the written quote, precisely so the payment step is never a surprise.
8. Warranties
Island Marine Repair LLC does not offer any express or implied warranties on parts or labor. All manufacturer warranties on parts are honored through the manufacturer directly.
9. Vessel Condition and Pre-Existing Issues
Boats, especially in salt water, develop conditions over time that are not visible until systems are opened or operated. We are not responsible for pre-existing damage, corrosion, deferred maintenance or latent defects, or for their consequences discovered or manifested during service. Where we find such conditions, we document them, tell you plainly, and quote the fix separately; deciding what to do about them is always your call.
10. Manufacturer Warranties
If your engine or equipment is covered by an active manufacturer warranty for the problem at hand, we will tell you, because that repair may belong at an authorized dealer at no cost to you. Work we perform on warranted equipment at your direction is performed as an independent service provider; we are not an authorized warranty repair facility for the manufacturers whose products we service unless expressly stated.
11. Limitation of Liability
To the maximum extent permitted by Florida law: our total liability arising from any service is limited to the amount you paid us for that service; we are not liable for indirect, incidental, consequential or special damages, including loss of use of the vessel, lost fishing days, charter income, towing, dockage or travel costs; and nothing in these Terms limits liability that cannot be limited under applicable law. We carry insurance appropriate to our trade and will provide proof of coverage on reasonable request.
12. Customer Responsibilities
You agree to: provide accurate information about the vessel and its symptoms; disclose known problems, prior repairs and modifications relevant to the work; secure or remove valuables from the work area; maintain the vessel between services in a reasonably prudent manner; and follow any operating or break-in guidance we provide after a repair.
13. Website Use
The content of islandmarinerepair.com, including text, images and branding, belongs to Island Marine Repair LLC and may not be copied or republished without permission. You agree not to misuse the website, including attempting to interfere with its operation or submitting false or misleading information through our forms. Boat-care information on our website and blog is general guidance, not a diagnosis of your specific vessel; when in doubt, have the boat looked at.
14. Third-Party Links and Services
Our website links to third-party services such as Google reviews and Facebook. Those services are governed by their own terms and policies, and we are not responsible for their content or practices.
15. Reviews and Communications
We love honest reviews and never script them. By sending us photos of your vessel in connection with service, you permit us to use them for diagnosis and service records; we will not publish photos identifying you or your vessel in our portfolio or social media without asking you first.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida. Any dispute arising from these Terms or our services will be resolved in the state courts located in Lee County, Florida. Before any formal dispute, you agree to contact us first and give us a genuine opportunity to resolve the issue directly; in our experience, a straight conversation solves nearly everything.
17. Changes, Severability and Entire Agreement
We may update these Terms from time to time, with the effective date revised above; continued use of the website or services after changes are posted constitutes acceptance. If any provision of these Terms is found unenforceable, the remainder continues in effect. These Terms, together with your approved written quotes and our Privacy Policy, form the entire agreement between you and Island Marine Repair LLC regarding our services and website.
